Appellant Anthony William Young was charged with felony burglary in violation of section 459 of the Penal Code. A preliminary hearing was held on July 2, 1986, after which appellant pleaded guilty to the offense charged on the condition that the prosecutor recommend at sentencing that the court make an "unusual case" finding and grant probation with a condition of a six-month jail term.
